TRIPS Agreement, 1994

  • The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) gave comprehensive international protection to geographical indications.
  • It came into force in 1995 as part of the WTO framework.
  • India, as a WTO member, was required to establish legal protection for GIs.

 Indian GI legislation

  • To fulfil its obligations under TRIPS, India enacted Geographical Indications of Goods (Registration and Protection) Act, 1999 which came into force in 2003
  • The Act provides legal protection to goods whose quality, reputation or other characteristics are essentially attributable to their geographical origin.
  • The Act established the Geographical Indications Registry headquartered in Chennai, Tamil Nadu
  • It operates under the Controller General of Patents, Designs and Trade Marks (CGPDTM), Department for Promotion of Industry and Internal Trade (DPIIT), Ministry of Commerce and Industry.

Indian GI products

  • Darjeeling Tea became India’s first registered GI, in 2004.
  • It is associated with the Darjeeling region of West Bengal and is known for its distinctive characteristics resulting from the region’s climate, soil and altitude.
